These Terms of Service apply to consumers with a residence and shipping address in the United States.

1. Scope

These Terms of Service (“Terms”) apply to all orders placed with Nerviana (“we”, “us”) through www.nerviana.com by private customers residing in the United States, provided the products are not purchased for commercial or professional resale. By placing an order, you agree to these Terms, our Refund Policy, Shipping Policy and Privacy Policy.

2. Prices and shipping costs

All prices are shown in U.S. dollars. Shipping within the United States is free and included in the price. Any applicable sales tax is calculated and displayed at checkout before you complete your purchase. We reserve the right to correct obvious pricing errors; if a product was listed at an incorrect price, we'll contact you before shipping and you may cancel the order for a full refund.

3. Payment methods

We accept Shop Pay, PayPal, Apple Pay, Google Pay and major credit and debit cards (Visa, Mastercard, American Express, Discover). Payment is due at the time of order. Your card or payment account is charged when the order is placed.

4. Order acceptance

Your order is an offer to purchase. We accept it by sending an order confirmation email. We may refuse or cancel an order, for example in case of suspected fraud, unavailability of the product, or pricing errors. If we cancel an order you have already paid for, we'll refund you in full without delay.

5. Delivery

We deliver only to addresses within the United States. Delivery times are estimates, not guaranteed dates; details are in our Shipping Policy. In the event of circumstances beyond our control (e.g. natural disasters, war, pandemics, carrier disruptions), delivery may be delayed or become impossible; in that case we'll inform you and refund any payments already made. If a delivery would only be possible at unreasonable expense, we reserve the right to decline it and refund you immediately.

6. Subscriptions (Subscribe & Save)

If you choose a subscription at checkout, the following applies:

• Your subscription renews automatically at the interval shown at checkout (e.g. every 30 days) and your payment method on file is charged at the subscription price shown at the time of sign-up, until you cancel.
• We'll send you a reminder email before each renewal charge.
• You can cancel at any time with immediate effect for future renewals, either through your customer account on www.nerviana.com or by emailing support@nerviana.com. Cancellation is as easy as signing up and requires no phone call.
• Cancellation takes effect for renewals that have not yet been processed. Orders already shipped are handled under the Refund Policy.
• We may change the subscription price with at least 30 days' notice by email; if you don't agree, you can cancel before the new price takes effect.

7. Returns, exchanges and the 60-Day Money-Back Guarantee

We offer a 60-Day Money-Back Guarantee on your first order. Details on how to return items, who pays return shipping, the return address and the refund process are set out in our Refund Policy. For hygiene and health reasons, only unopened, originally sealed products can be returned or exchanged; items that are damaged, defective or incorrectly delivered are always replaced or refunded.

8. Title and risk of loss

Title to the products passes to you when we receive full payment. Risk of loss passes to you upon delivery to the shipping address you provided.

9. Defective products

If a product is defective, damaged or not what you ordered, contact us at support@nerviana.com within 14 days of delivery with a photo and we'll send a replacement free of charge or refund you. The following are not defects: a) damage or impairment caused by improper use or storage, or by not following the usage instructions (e.g. storage in extreme heat, humidity or direct sunlight, or use after the printed best-before date); b) normal product characteristics, such as slight natural variations in color or smell of the ingredients; c) issues caused by use despite the contraindications listed in section 15.

10. Product information and intended use

NerViana+® is a topical patch for external use on intact skin containing magnesium chloride, vitamin B12 (methylcobalamin), L-methylfolate and alpha-lipoic acid. It is not a drug and not a medical device. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.

The product is not a substitute for professional medical advice, diagnosis or treatment. If you have a medical condition, are unsure whether the product is suitable for you, or have any questions before use, consult your doctor or pharmacist.

Statements on this website about the properties, ingredients or areas of use of our products are not to be understood as therapeutic claims. Statements about magnesium, vitamin B12 and other ingredients refer to general nutritional science regarding these nutrients and not to a product-specific effect.

Directions for use: For external use only. Do not apply to open wounds or to irritated, injured or diseased skin. Do not swallow. Avoid contact with eyes and mucous membranes. Keep out of reach of children. If skin irritation, redness or an allergic reaction occurs, stop use immediately and consult a doctor if necessary. Use of the product is at your own risk. If you have a pre-existing condition, are pregnant or breastfeeding, take medication, or have a particular health risk, consult your doctor before use.

11. Testimonials and results

Testimonials and reviews on this website reflect the personal experiences of individual users and are not proof of effectiveness. Individual results vary. We make no guarantee of any specific result. Studies cited on this website relate to the ingredients in general and not necessarily to the NerViana+® product itself; references are provided for information only.

12. Intellectual property

All content on this website (text, images, graphics, logos, videos, trademarks including NerViana+®) is owned by us or our licensors and protected by copyright and trademark law. You may not copy, reproduce or use it without our written permission.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from the use of our website or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence or for fraud.

We are not liable for damage caused by improper use, failure to follow the directions for use, or use despite the contraindications listed in section 15.

14. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This choice of law does not deprive you of the protection of mandatory consumer protection laws of the U.S. state in which you reside.

If you have a problem with an order, please contact us first at support@nerviana.com; we resolve almost every issue directly and quickly. Any dispute that cannot be resolved informally shall be brought in the courts of Berlin, Germany, unless mandatory law requires otherwise.

15. Important notice and health disclaimer

Consult your doctor before use if you have any of the following: nerve pain or unexplained sensations (e.g. tingling, burning, numbness), polyneuropathy, diabetes, kidney disease or reduced kidney function, cardiovascular disease, high blood pressure, use of blood pressure or heart medication, known electrolyte disorders, or any other chronic condition. The product does not replace treatment by doctors, neurologists, diabetologists, physical therapists or other healthcare professionals. Never stop, reduce or change prescribed medication without consulting your doctor.

Contraindications – do not use if: you have a known hypersensitivity or allergy to any ingredient (in particular magnesium compounds, vitamin B12/cobalamins, or components of the adhesive or carrier matrix); you have open wounds, eczema, burns, infections or other skin conditions in the area of application; you have severe kidney failure; or you are under 18 years of age. During pregnancy and breastfeeding, use only after consulting your doctor.

Insurance: The product is not a medical device or prescription drug; it is generally not reimbursed by health insurance or Medicare/Medicaid.

If symptoms persist, worsen or are unclear, see a doctor promptly. Numbness, tingling or burning can be symptoms of serious underlying conditions (e.g. diabetes, nerve damage, circulatory disorders) that require medical evaluation. In an emergency, such as sudden paralysis, sudden numbness on one side of the body, speech or vision problems, chest pain or shortness of breath, call 911 immediately.

16. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time of your order applies to that order.

17. Final provisions

If any provision of these Terms is found to be invalid, the remaining provisions remain in effect. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding your order.
